Terms of Service

These Terms of Service (“Terms”) govern your use of the Platform — Medicare Agent Scout (medicareagentscout.com) and ACA Agent Scout (acaagentscout.com), each operated by Agent Scout LLC, a California limited liability company (“Agent Scout LLC,” “Scout,” “we,” “us”; together with each directory, the “Service” or the “Platform”). The same Terms, version, and effective date apply on both domains. By using either website, creating a listing, or submitting a request, you agree to these Terms. If you do not agree, do not use the Service.

What the Platform is — and is not

Medicare Agent Scout and ACA Agent Scout are independent online directories that help consumers find independent licensed insurance agents and provide those agents with visibility and lead-generation tools. We are a non-government resource. We are not an insurance agency or insurer; we do not sell insurance, represent any plan or carrier, enroll anyone in any plan, or provide insurance, legal, tax, or financial advice. Agent Scout LLC and the directories are not affiliated with or endorsed by Medicare, Medicare.gov, CMS, HealthCare.gov, the Health Insurance Marketplace, Georgia Access, another State-based Exchange, or another government agency. Any decision about coverage is between you and a licensed agent. For Medicare, you can always contact Medicare.gov or 1-800-MEDICARE for information on all of your options; for ACA/Marketplace coverage, visit HealthCare.gov or your state’s exchange, or get free, unbiased help from a Marketplace Navigator or certified assister.

The Platform does not discuss, compare, rank, recommend, or quote any specific plan. Neither directory is an Exchange, insurer, web-broker, direct-enrollment entity, application or enrollment system, eligibility or subsidy decision-maker, or plan-recommendation service. Medicare Agent Scout does not complete a Scope of Appointment; ACA Agent Scout does not collect eligibility information and does not submit, update, or change Marketplace or Exchange applications or enrollments. A contact-request, contact-consent, or contact-routing record documents only your request to be contacted: it is not Marketplace consent and does not satisfy an agent’s consent or application-review obligations. The Service connects you with an independent licensed agent you select, and any discussion of plans, any Scope of Appointment or consent to assist, any application, and any enrollment occurs solely between you and that agent.

Using the directory (consumers)

  • The directory is provided for informational purposes to help you find and contact independent licensed agents. It is free for consumers to use.
  • When you submit a contact request, your information is sent to the single agent you selected (or one matched agent for “match me” requests) unless you separately agree to be contacted by more than one — subject to limited disclosures to service providers and for fraud prevention, safety, customer support, legal obligations, and corporate transactions.   • You agree to provide accurate information and not to misuse the Service, including by submitting another person's information without authorization.
  • By submitting a contact request, you authorize the single agent you select to contact you using the phone number, email, or other methods you provide regarding the insurance options you asked about, and you confirm this is your prior express consent to that contact. This consent is limited to the one agent you select.

Your decisions and the agents you contact

Scout provides a venue to find and contact independent licensed agents; the agents are independent professionals, not our employees or partners. You are responsible for independently evaluating any agent before working with them, and you rely on your own judgment in choosing coverage. An agent is solely responsible for the services and advice they provide, and Scout is not liable for any loss, cost, damage, or claim arising from an agent's products, services, conduct, or advice. We do not make any coverage decision, do not issue insurance, and nothing on the Service is insurance, legal, tax, or financial advice.

Agent listings

  • Agents must be independent, licensed insurance professionals and must keep their information accurate and current.
  • Agents are solely responsible for their own marketing practices and compliance, including license accuracy; for Medicare listings, CMS Medicare marketing rules (including TPMO requirements) and Scope of Appointment requirements; for ACA listings, CMS Marketplace agent/broker standards (including 45 C.F.R. § 155.220) and applicable State-based Exchange rules; carrier rules; call recording where applicable; and obtaining any required permission to contact. Each agent accepts the applicable written agreement and attestation at signup, which we retain.
  • Agents on Medicare Agent Scout are bound by the Medicare Agent Scout Agent Listing Agreement; agents on ACA Agent Scout are bound by the ACA Agent Listing Agreement. If these Terms conflict with an accepted Agent Listing Agreement, the Agent Listing Agreement controls for that listing.
  • We may review, edit, suspend, or remove listings that violate these Terms or our content policies, with or without notice.
  • Prohibited marketing claims include superlatives, savings guarantees, and any implication of government affiliation or Medicare endorsement.

Plans, add-ons, and billing

  • Premium listings are billed at $299/year and include one main location and up to 8 priority ZIP codes.
  • Additional Locations ($149/year each) and Extra ZIP Packs ($59/year each, 8 priority ZIP codes; up to 2 packs) are available on active Premium listings.
  • Priority ZIP codes provide priority visibility only — never exclusive ownership of a ZIP code or territory. Each ZIP code is limited to a small number of Premium placements, and placement may rotate fairly among them.
  • Additional locations must represent a real office, satellite office, or regularly served local market. We may review listings for accuracy, license status, consumer clarity, and compliance.
  • One paid subscription grants the corresponding listing tier on the other Agent Scout directory at no additional charge; the included tier ends when the paid subscription ends. Agent Scout LLC is the merchant, and Stripe (or another disclosed payment processor) handles payment information.
  • Subscriptions renew annually unless canceled. Renewal price, billing frequency, automatic renewal, the cancellation method, any promotional pricing and its expiration, taxes, and optional add-ons are disclosed at checkout. If a payment fails or a subscription is canceled, paid features (including priority placement, add-on entitlements, cross-directory tiers, and any promotional price protection) are removed after any grace period, but profile data is preserved.

Refunds and cancellation

  • Paid listings and add-ons are billed annually. You can cancel at any time to stop the next renewal; cancellation takes effect at the end of the current paid term.
  • You expressly consent to automatic annual renewal. We will charge your payment method the then-current annual fee each year unless you cancel before the renewal date. You may cancel at any time through your account dashboard; cancellation stops the next renewal and takes effect at the end of the current paid term.
  • Fees are non-refundable, including for partial terms, except where required by law. We may, at our discretion, make exceptions.
  • A paid listing provides visibility and tools; it does not guarantee leads, calls, enrollments, or any business outcome.

Acceptable use

You agree not to:

  • Scrape, harvest, or bulk-collect agent or consumer data, or use the Service to build a competing dataset or directory.
  • Submit false, misleading, or non-compliant content, fabricated reviews, or another party's information without authorization.
  • Interfere with, overload, or attempt to gain unauthorized access to the Service or its systems.
  • Use the Service for any unlawful purpose or in violation of CMS rules or applicable insurance regulations.

Reviews and user content

Reviews and other content you submit must be truthful and your own. We moderate submissions and may decline or remove content that is false, fraudulent, abusive, or non-compliant.

When you submit content to the Service — including your profile information, bio, headshot, photos, video, and testimonials — you grant Scout a non-exclusive, royalty-free, worldwide license to host, display, reproduce, and adapt that content to operate, promote, and market the Service and your listing (for example, on the site, in search results, and in related promotional materials). You represent that you own or have the rights to the content you submit and that it does not infringe anyone else's rights. This license ends when the content is removed from the Service, except for copies already used in distributed materials or retained as required by law.

Intellectual property

The Service, including its design, text, and branding, is owned by us or our licensors and is protected by applicable laws. You may not copy, reproduce, or reuse it except as permitted by these Terms.

Copyright complaints (DMCA)

We respect intellectual property rights and respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act (DMCA). If you believe content on the Service infringes your copyright, send a written notice to our designated agent that includes: identification of the copyrighted work; identification and location (URL) of the allegedly infringing material; your name, address, phone, and email; a statement that you have a good faith belief the use is not authorized; a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act for the owner; and your signature (physical or electronic).

Send notices to our designated agent at support@medicareagentscout.com. We will remove or disable access to material that is the subject of a valid notice, notify the affected user, accept counter-notifications, and terminate repeat infringers in appropriate circumstances.

Third-party links

The Service may link to third-party websites (including Medicare.gov, HealthCare.gov, state exchanges, and agent websites). We do not control and are not responsible for third-party content, practices, or privacy policies.

No guarantees

We do not guarantee any search ranking, lead volume, savings, enrollment, or business outcome.

Disclaimer of warranties; limitation of liability

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, and we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for the acts, omissions, or advice of any agent listed in the directory.

Our total aggregate liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of (a) the total fees you paid us in the twelve months before the claim arose, or (b) USD $100. Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for fraud, willful injury to a person or property, violation of law, or gross negligence; if any limitation in this section is held unenforceable as to a particular claim, it remains in full effect as to all other claims.

Indemnification

You agree to indemnify and hold harmless Agent Scout LLC, which operates Medicare Agent Scout, and its members, officers, and operators from claims arising out of your use of the Service, your content, or your violation of these Terms or applicable law. Agents additionally agree to indemnify us for claims arising from their marketing, compliance, or licensing conduct.

Governing law

The Service is operated by Agent Scout LLC, a California limited liability company (California Secretary of State Entity No. B20260278128). These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. For any dispute not subject to arbitration under the “Dispute resolution” section below, and for any action to compel arbitration or enforce an award, the exclusive forum is the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction and venue there.

Dispute resolution

This section applies to any dispute, claim, or controversy between you and us arising out of or relating to the Service or these Terms (a “Dispute”). Before starting mediation or arbitration, the complaining party must send the other written notice describing the Dispute and the relief sought — to us at contact@medicareagentscout.com, and to you at the email address on your account. The parties will then negotiate in good faith to resolve the Dispute. Neither party may begin mediation or arbitration until 30 days after that notice is sent.

If the Dispute is not resolved within that 30-day period, the parties will submit it to mediation before a single mediator administered by JAMS in Los Angeles County, California, sharing the mediator's fees equally. Completing mediation, or participating in good faith for at least 30 days after a mediation request, is a precondition to arbitration.

If the Dispute is not resolved within 60 days after the mediation request, it will be finally resolved by binding arbitration administered by JAMS under its applicable rules, before one arbitrator, seated in Los Angeles County, California. The arbitrator decides all issues, including arbitrability, and may award any relief a court could, except as limited in this section. Judgment on the award may be entered in any court of competent jurisdiction.

Disputes will be resolved only on an individual basis. You and we waive any right to bring or participate in a class, collective, consolidated, or representative action, and the arbitrator may not consolidate more than one party's claims or preside over any class or representative proceeding.

Either party may (a) bring a qualifying claim in small claims court, (b) seek injunctive or equitable relief in the courts identified in “Governing law” to protect its intellectual property or confidential information, and (c) pursue a claim for public injunctive relief in court. Claims for public injunctive relief are not subject to arbitration or the class-action waiver. If the class-action waiver is held unenforceable as to a particular claim, that claim will proceed in court while all other Disputes remain in arbitration.

You may opt out of this Dispute resolution section by sending written notice to contact@medicareagentscout.com within 30 days of first accepting these Terms, stating your name and that you are opting out. Opting out does not affect any other part of these Terms.

Electronic communications

When you use the Service or contact us, you consent to receive communications from us electronically — by email or by notices posted on the Service. You agree that agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that they be in writing.

Changes to these Terms

We may update these Terms from time to time. We will revise the “last updated” date above when we do, and your continued use of the Service after changes take effect constitutes acceptance.

Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Section headings are for convenience only. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) survive. These Terms, together with the Privacy Policy and Disclaimers, are the entire agreement between you and us regarding the Service and supersede prior understandings on that subject.
